These Terms and Conditions govern your use of our services, including scheduling appointments, consignment of items for sale, temporary storage as part of the consignment process, and all interactions with our website and business. By using our services, you agree to comply with these terms. Please read them carefully.
1.Definitions
The following terms are used throughout these Terms and Conditions:
"Company" refers to StufBuf, the provider of consignment and related services.
"Customer" refers to the individual or entity using our services.
"Services" refers to all offerings provided by StufBuf, including item consignment, temporary item storage as part of the consignment process, scheduling appointments, and online tools.
"We," "us," or "our" refers to StufBuf.
"Agreement" refers to these Terms and Conditions.
2. Service Description
StufBuf offer the following services:
Collect up to 10 items per batch from your residence or agreed location
Consignment services for the sale of customer items.
Scheduling for consultations or property visits.
Temporary storage of items strictly as a part of the consignment process.
Tools for tracking consigned items and related logistics.
We do not operate as a traditional storage company. Storage is a by-product of the consignment process, and while we prioritize secure storage, we currently do not offer 24/7 surveillance or climate-controlled environments. Items will still be stored securely with reasonable precautions. These Terms and Conditions are subject to change.
3. Responsibilities
Customer Responsibilities:
Provide accurate and complete information when using our services.
Ensure that all consigned items comply with legal regulations and are not hazardous, illegal, or perishable.
Notify the Company promptly of any changes to their contact information or other relevant details.
Confirm that they have the legal right to consign items for sale.
Read the terms and conditions before using the services.
StufBuf Responsibilies:
Manage the listing of items on suitable marketplaces.
Provide daily monitoring and optimization of listings to ensure maximum sales.
Handle all client inquiries and negotiations.
Package, ship, and manage returns when items are sold.
4. Appointment Scheduling
Booking Process: Customers can book appointments using the scheduling tool on our website or by phone.
Customer Information: Customers must provide accurate property details, including the address and any special instructions.
Cancellation Policy: Appointments must be cancelled or rescheduled at least 24 hours in advance.
5. Termination of Agreement
This agreement may be terminated by either party with a 30-day written notice if:
The Client is dissatisfied with the service.
StufBuf is unable to meet the terms of the agreement.
Upon termination:
Unsold items will either be returned to the Client, given to charity, resold or disposed of if agreed upon.
6. Consignment and Temporary Storage Terms
Prohibited items: While in StufBuf's temporary possession for consignment, customers must not consign or store
Flammable or hazardous materials
Illegal or stolen goods
Perishable goods that could spoil and cause damage or hygiene concerns
This ensures the safety, legality, and hygiene of our operations. Under no circumstances will StufBuf Consign the following items.
Weapons, firearms, self-defense items, or any type of explosive materials
X-rated or adult items
Fake or counterfeit goods
Any items that are deemed hazardous, illegal, or unethical
Liability: StufBuf is not liable for: Damage or loss due to circumstances beyond our control (e.g., natural disasters). Unreported damages to consigned items.
Secure Storage: Items will be stored securely with reasonable precautions, though we do not currently offer 24/7 surveillance or climate-controlled environments.
Access: Access to consigned items must be requested in advance and is subject to availability.
Withdrawal and Unsold Items: If at any point the customer decides they don't want to sell an item, they will automatically incur the £5 processing fee and will either have to collect or have the item returned at a nominal cost decided by the business. If your item/items haven't sold within 30 calendar days from the date of collection, additional options for further consignment or collection will be discussed.
Collection and Handling:
StufBuf will collect items from the Client's home within a designated service area.
StufBuf will facilitate the packaging of items on collection.
StufBuf will document all items and confirm the current condition of said items.
StufBuf will discuss pricing of individual items and confirm with the client on potential prices.
StufBuf is not responsible for items damaged due to improper packaging.
Items will be stored securely until sold.
Appointment Time Frame: Appointments will be scheduled in 30-minute slots, though the appointment itself may be quicker.
7. Handling of Unsold Items
Handling of unsold items at the end of the selling period: At the end of the agreed selling period, as agreed with the client, all unsold item(s) will be either: returned to the client for a fee; donated or disposed of responsibly. At the discretion of StufBuf, items may be stored for an additional period. If the client does not select a preference within 14 calendar days of the selling period closing, StufBuf reserves the right to donate or dispose of the unsold item(s); or retain possession of the items at the discretion of StufBuf.
8. Bank Details Collection & Payment & Fees
StufBuf collects your bank details at the time of item collection in order to process payments directly to you once your items are sold.
We understand that this information is sensitive, and as such, it is not stored digitally, emailed, or recorded in any written or electronic format. Your bank details are entered directly and securely into our business banking app (e.g. Monzo) at the time of collection and used solely for the purpose of processing your final payment.
No permanent records of your banking information are retained by StufBuf. This method ensures maximum protection of your data and aligns with our strict commitment to GDPR compliance.
Payment Methods: Payments can be made via domestic bank transfer or any other payment methods at StufBuf's discretion.
Processing Fees: A processing fee will be deducted after the commission of the item/items is achieved. If StufBuf doesn't sell any of your items, the processing fee will be waived and absorbed by StufBuf.
Refunds: Refunds, if applicable, will be processed in accordance with our refund policy.
9. Commission
StufBuf will take a sliding commission based on the value of each item sold. The commission scale is as follows:
Items valued up to £100: 30% commission
Items valued between £101 and £500: 25% commission
Items valued between £501 and £1,000: 20% commission
Items valued over £1,000: 15% commission
This ensures that the commission is aligned with the value of the item
10.Privacy & Data Protection (GDPR Compliance)
StufBuf is committed to protecting your personal data and respecting your privacy in accordance with the UK General Data Protection Regulation (UK GDPR).
By using our services, you agree that we may collect, process, and store personal information such as your name, address, contact details, and relevant item information for the sole purpose of providing and managing our resale services. This includes inventory tracking, communication regarding item sales, and processing any payments due to you.
We will only retain your data for as long as necessary to fulfil the purposes we collected it for. Typically, your information will be securely stored for a period of up to 6 months after the completion of our service or until all associated sales and payments are concluded. You have the right to access, correct, or request deletion of your personal data at any time by contacting us directly.
We will never sell or share your information with third parties, and access is restricted to those within the StufBuf team who require it to carry out their duties.
By entering into an agreement with StufBuf, you acknowledge that you understand and accept this privacy policy and our responsibility to handle your data securely and transparently.
We may use cookies to collect information about your use of our website.
11. Limitations of Liability
StufBuf's liability is limited to the value of the service fee paid for the specific transaction in question.
We are not liable for indirect, incidental, or consequential damages arising from the use of our services.
Disclaimer of Warranties: StufBuf provides services "as is" without any express or implied warranties, including but not limited to implied warranties of merchantability or fitness for a particular purpose.
12. Dispute Resolution
Any disputes arising under these terms will be resolved through mediation. If mediation fails, disputes will be subject to the jurisdiction of Your Location courts.
Customers are encouraged to contact StufBuf directly to resolve issues amicably.
13. Modifications to Terms
StufBuf reserves the right to update these Terms and Conditions at any time. Customers will be notified of significant changes through our website or via email.
